These terms govern your use of BitePattern. By creating an account you agree to them.

Safety — read this one

BitePattern is a fishing log, not a safety device. Never use it to decide whether it is safe to go to the water.

The app reports swell, wind, tide and sea conditions from third-party forecast data. That data can be wrong, out of date, or unavailable. Conditions at a specific rock, gully or beach can differ completely from the regional forecast, and can change within minutes.

You are solely responsible for your own safety. Always check official marine weather warnings, tell somebody where you are going, wear a lifejacket where appropriate, and use your own judgement at the water’s edge. If the app says conditions look good and your eyes say otherwise, believe your eyes.

We accept no liability for any injury, loss or death arising from a decision to fish.

What the service does

BitePattern records your fishing trips and catches, attaches environmental conditions to them, and estimates which conditions have historically produced fish for you.

Those estimates are estimates. They are derived from your own records using statistical similarity, and they are labelled with the confidence we actually have — including telling you plainly when we do not have enough of your history to say anything useful. We do not promise you will catch fish. Nobody can.

Your account

You must be at least 13 years old, give accurate registration details, and keep your password secure. You are responsible for activity under your account. Tell us promptly at [SUPPORT EMAIL] if you believe it has been compromised.

Free tier and subscription

Free tier. New accounts may log up to 10 fish, or use the app for 30 days — whichever comes first — at no cost and without providing payment details.

Subscription. Continued use after that requires a paid annual subscription at the price shown in the app at the time of purchase.

Billing. Subscriptions are sold and billed through the Apple App Store or Google Play, under their terms, not ours. They handle payment, renewal and refunds.

Auto-renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Manage or cancel your subscription in your Apple or Google account settings — we cannot cancel it for you.

Refunds are handled by Apple or Google under their policies. We have no ability to issue them directly.

Price changes will be notified to you in advance and will only ever apply from your next renewal, never mid-term.

Nothing you have already logged is ever held hostage. If your subscription lapses, you keep access to your own records and can export them to CSV at any time, subscribed or not.

Your data belongs to you

You retain all rights to the trips, catches, marks, notes and photos you create. You grant us only the limited licence needed to store that content, process it, and show it back to you — nothing more.

We will not publish your marks, sell your data, or use your catches to build a public map. If features for sharing with other anglers are added in future, they will be opt-in and per-item.

Acceptable use

Do not:

  • Use the service unlawfully, or to fish in contravention of any permit, closed season, size limit or bag limit
  • Attempt to access another user’s account or data
  • Scrape, reverse-engineer, or resell the service
  • Overload or disrupt our infrastructure
  • Upload unlawful content, or photographs of people who have not consented

We may suspend or terminate accounts that breach these terms.

Fishing law is your responsibility

Permits, licences, closed seasons, protected species, size and bag limits differ by country, province and even by beach, and they change. The app does not check them and does not know them. Complying with the law where you fish is entirely your responsibility.

Availability

We aim to keep BitePattern running but do not guarantee uninterrupted service. Logging works offline by design, so a server outage does not stop you recording a trip — your records sync when connectivity returns.

We may modify or discontinue features. If we ever discontinue the service entirely, we will give reasonable notice and a means to export your records.

Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss, for lost fishing opportunity, or for decisions made in reliance on the app’s estimates.

Where liability cannot lawfully be excluded, it is limited to the amount you paid us in the 12 months before the claim.

Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 or any other law that cannot be excluded by agreement.

Termination

You may stop using BitePattern and delete your account at any time. We may suspend or terminate your account for breach of these terms, with notice where reasonable.

Changes

We may update these terms. Material changes will be notified in the app before taking effect. Continuing to use the service after that constitutes acceptance.

Governing law

These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction.
